INSURANCE BAD FAITH

Ask yourself the following questions:

  • Have you filed a claim with your insurance company but you are getting the run-around?

An insurance policy is a contract. You pay a premium and in exchange the insurance company agrees to pay you when you have a valid claim. A person pays for insurance in order obtain security and protection. If your insurance company fails to pay or pays too little you may have a claim for BREACH OF CONTRACT against your insurance company.

In addition, your insurance company owes you a "duty of good faith and fair dealing." If your insurance company does not conduct itself in good faith and if it deals unfairly with you, you may have a claim for BAD FAITH against it. The following conduct by your insurance company are some examples of conduct that may be evidence of bad faith:

  • Failure to promptly respond to you concerning your claim.
  • Failure to conduct a reasonable investigation concerning your claim.
  • Failure to affirm or deny coverage within a reasonable period of time.
  • Not attempting in good faith to effectuate a prompt, fair and equitable settlement.
